Rhode Island-Specific Rules

Minor & Provisional Licensing

  • Applicants between 16 and 18 need a 33-hour classroom driver ed course plus a computerized test; applicants over 18 skip the classroom course.
  • Driver ed enrollment is allowed from age 15 (if at least 15 years 10 months when the class starts) even though the permit itself requires age 16.
  • A supervising driver must be licensed at least 5 years and at least 21 years old.
  • A Limited Instructional Permit must be held at least 6 months before the road test; it's valid 1 year or until 18, whichever comes first.
  • A Limited Provisional License needs 6 violation-free months on the permit, a passed road test, and a signed statement of 50 hours driving (10 hours at night).
  • Limited Provisional License holders can't drive alone 1 a.m.-5 a.m., but may drive unsupervised outside that window to/from work or volunteer emergency service.
  • The Limited Provisional License expires at 18; only one passenger under 21 allowed in the first 12 months (family/household exempt).
  • A Full Operator's License needs age 17 years, 6 months, 12 months on the provisional license, and a clean 6-month record.
  • A failed road test means a wait of at least 30 days before retesting; the written test can't be retaken until the current permit expires.
  • A valid out-of-state license (or one not expired more than 1 year) skips both tests when transferring; a prior RI license not expired more than 3 years gets its old number back.

Licensing Procedure & Documents

  • First license: $27.50 (under 18) or $39.50 (18+) for a two-birthday term; renewal after that is $62.50 for five years.
  • The Limited Provisional License fee is $12.50.
  • The road test vehicle must be RI-registered with the owner present, or a notarized permission letter if not.
  • Immediate road-test failure: leaving the roadway, any moving violation, lack of cooperation, or a collision/contact.
  • Transferring an out-of-state license costs $44.50; the RI license is valid up to two years, then renewable for five.
  • Signal at least 100 feet before a turn, and when pulling out of a parking space.
  • Headlights required sunset-sunrise, when visibility drops below 500 feet, in rain/snow, or whenever wipers are on.
  • Drivers must certify at license/registration renewal that they'll carry insurance proof; missing proof in the vehicle costs $500.

Rules of the Road

  • Right turn on red is allowed after a full stop unless posted otherwise, yielding to oncoming traffic and pedestrians first.
  • The seat belt law is primary for all ages -- a driver can be pulled over just for an unbuckled occupant; $40 fine per occupant.
  • Under 8, under 57 inches, and under 80 lbs needs a rear-seated child restraint system; meeting either size threshold allows a rear seat belt instead.
  • $85 fine for a child riding front-seat or over 7 without a belt; a missing required restraint system means a court appearance.
  • Stop fully for a school bus's flashing red lights; a first violation is up to a $300 fine and/or a suspension of up to 30 days.
  • No stop needed for a school bus on the opposite side of a divided highway, or one stopped in a loading zone.
  • Bicycle riders/passengers 15 years old or younger must wear a certified helmet; no more than two bikes riding side by side.
  • At an uncontrolled intersection, the driver on the left yields to the vehicle on the right.
  • Earphones or a headset while driving on a public highway are not allowed.
  • Drivers under 18 can't use a cell phone at all while driving, hands-free/speakerphone included, except in an emergency.
  • Texting while driving is forbidden for a driver of any age.

DUI & Alcohol Laws

  • DUI (any age): BAC 0.08%+. DWI (under 21 only): BAC 0.02% to under 0.08%.
  • Refusing a chemical test costs at least six months without a license, plus a fine, assessment, community service, and treatment/school.
  • First DUI (21+, 0.08%-0.1%): up to 1 year prison, 30-180 day suspension, $100-$300 fine, plus assessment and community service.
  • First DWI (18-21 years old): 1-3 month suspension, $250 fine, 30 hours community service.
  • Consuming alcohol while driving is illegal for a driver of any age in Rhode Island.
  • A second DUI within 5 years (0.08%-0.15% or unknown) requires an ignition interlock for 1-2 years after the sentence.

Crashes, Insurance & License Actions

  • A suspension doesn't start until the license is actually surrendered or forwarded to the DMV.
  • All RI drivers must carry liability insurance; owners certify coverage at each registration renewal.
  • Suspensions become public record, viewable by insurers -- rates may rise significantly as a result.
  • 1-10 mph over the limit: $85 fine. 11+ mph over: $195 minimum plus $10 per extra mph.
  • Littering on a roadway carries a $500 fine.
