Illinois-Specific Rules

Minor & Provisional Licensing

  • Instruction permit (age 15-17) must be held at least 9 consecutive months before applying for a license.
  • 50 hours of supervised practice required before licensing under 18, including 10 hours at night.
  • Permit Phase curfew: Sun.-Thu. 10 p.m.-6 a.m.; Fri.-Sat. 11 p.m.-6 a.m.
  • Permit Phase passenger limit: one in the front seat, plus only as many in back as there are safety belts.
  • Initial Licensing Phase (16-17): only one passenger under 20 for the first 12 months, unless a sibling or child.
  • A conviction during the Initial Licensing Phase can extend GDL restrictions past age 18.
  • Wireless/cellphone use -- even hands-free -- is banned for any driver under 19, except to contact emergency services.
  • First-time applicants ages 18-20 with no prior driver's ed must complete a 6-hour Adult Driver Education Course.
  • A parent/guardian who consented to a 16-17 year old's license can cancel it at any time, for any reason, until 18.
  • Under 21 with 2+ moving violations in 24 months: minimum 30-day license suspension.
  • Taking a driving exam for someone else is a criminal offense with a mandatory minimum 7 days in jail.
  • The written exam must be retaken every 8 years -- unless you have no traffic convictions.

DUI Laws & Penalties

  • DUI is legally classified as a violent crime in Illinois; a conviction stays on your record permanently.
  • First-offense Statutory Summary Suspension: 1 year for refusing testing, 6 months for failing it (.08%+ BAC).
  • Second offender within 5 years: 3-year suspension for refusal, 1 year for failing the test.
  • A 45-day temporary permit is issued after a DUI arrest before the suspension actually begins.
  • DUI revocation ladder: 1st offense = 1 year min., 2nd (within 20 yrs) = 5 years min., 3rd = 10 years min., 4th+ = lifetime.
  • A first DUI conviction under age 21 carries a minimum 2-year revocation -- double the adult minimum.
  • Any trace of alcohol for a driver under 21 while driving: minimum 3-month suspension.
  • Declining the ignition-interlock (BAIID/MDDP) program and driving during a DUI suspension anyway is a felony.
  • Illegal THC threshold: 5 ng/mL of whole blood, or 10 ng/mL of another bodily substance.
  • Refusing chemical testing after a crash causing death or serious injury: minimum 1-year revocation.

Speed, Right-of-Way & Legal Rules

  • Default speed limits (unless posted): 70 mph interstates/tollways, 65 mph four-lane highways, 55 mph other highways/rural.
  • Default speed limits: 30 mph city/town areas, 15 mph alleys.
  • School zone speed: 20 mph, but only 6:30 a.m.-4 p.m. on school days, with children present and signs posted.
  • At a 4-way stop with simultaneous arrival, the vehicle on the left yields to the vehicle on the right.
  • When passing, you must return to your lane before getting within 200 feet of an oncoming vehicle.
  • Every construction zone in Illinois is a no-passing zone, regardless of markings or whether workers are present.
  • Signal continuously at least 100 feet before turning in business/residential areas, 200 feet elsewhere.
  • A U-turn on a curve or hill requires at least 500 feet of visibility in all directions.
  • A qualifying crash must be reported within 30 minutes of it occurring.

Emergency Vehicles, School Buses & Work Zones

  • A school bus warns at least 100 feet before stopping (200 feet in rural areas).
  • Illegally passing a stopped school bus: mandatory $300 fine plus community service, on top of a license suspension.
  • If the vehicle's owner wasn't driving, they must identify the actual driver or face a 3-month registration suspension.
  • Photography and cellphone use are banned within 500 feet of an active emergency scene.
  • Construction-zone speed limits apply 24/7, whether or not workers are actually present.

Parking Rules & Technique

  • Parallel parking: right-hand wheels within 12 inches of the curb.
  • No stopping/standing within 30 feet of a STOP sign, YIELD sign, or traffic signal.
  • No stopping/standing within 20 feet of a fire station driveway.
  • No parking within 50 feet of the nearest rail of a railroad crossing.

Defensive Driving

  • Safety belts are required for all drivers and passengers age 8+, in both front and back seats.
  • Children must ride rear-facing until age 2, unless over 40 lbs or 40 inches tall (effective Jan. 1, 2019).
  • Headsets are banned while driving, except a single-sided headset/earpiece.
  • Holding a phone to use speakerphone still counts as a handheld violation -- it's not hands-free.
