Montana-Specific Rules
Minor & Provisional Licensing
- NCLP eligibility: 16 without traffic education, or 15 with a completed state-approved traffic education course; under-18 applicants need a parent/guardian/responsible-adult consent form.
- A Traffic Education Permit is available as young as 14 1/2 while enrolled in a state-approved course, under direct instructor supervision.
- GDL Step 1: 50 hours of supervised driving, including 10 hours at night, over a minimum of six months; NCLP held six consecutive months before applying for a restricted license.
- The GDL Step 2 restriction code lasts one year; no driving 11 p.m.-5 a.m. with limited exceptions.
- First-year restricted license passengers: one unrelated passenger under 18 for the first six months, three for the second six months (unless supervised).
- First-year restricted license violations: 20-60 hours community service (first offense), a six-month suspension (second offense).
- GDL Step 3 (full privileges) starts automatically on the date on the license or at 18, whichever comes first.
- A license for a resident under 21 expires on their 21st birthday, regardless of issue date.
- New residents have 60 consecutive days to convert an out-of-state license (30 for commercial).
- Military with a license exemption may drive up to 90 days after honorable discharge, with a year to renew without retesting.
Licensing Procedure & Documents
- Class D covers non-commercial vehicles under 26,000 lbs; requires vision, written, and road tests.

Rules of the Road

- Open containers must be locked away, in the trunk, or behind the last seat -- with exceptions for unbroken seals and camper living quarters.
- If a funeral procession's lead vehicle proceeds through a red light, the rest of the procession may follow with reasonable care.
DUI & Alcohol Laws
- Adult OUI threshold: 0.08% BAC. Under-21 threshold: 0.02%. Must be 21+ to buy or consume alcohol.
- First alcohol conviction: $300-$1,000 fine, 1-60 days possible jail, a six-month license suspension.
- Refusing a requested BAC test can cost you your license.
- Report a Drunk Driver: law enforcement contacts 37% of reported suspects, and 71% of those contacted are arrested.
- One standard drink: 1 1/2 oz of 80-proof liquor, 12 oz beer, or a 5 oz glass of wine -- processed at about one per hour.
Crashes, Insurance & License Actions
- Minimum liability insurance: $25,000/$50,000/$10,000 for injury/death of one, two+ people, and property damage.
- Evidence of insurance must be shown to law enforcement after a stop or collision, alongside license and registration.
- Driving uninsured: misdemeanor, $250-$500 fine or up to 10 days jail, plus 5 points; repeat offenses add a 90-day registration suspension (180 days for a third or subsequent offense).
- Unpaid court-ordered accident damages suspend license/registration until paid or 6 years pass.
- Owners of more than 25 registered Montana vehicles may qualify as self-insurers.
